IS IT A GLIMMER OF HOPE FOR AUSTRALIAN DAVID HICKS?

AddedNote: Recent rulings by the US court regarding with the so-called "enemy combatant" -- US citizen accused of person and detained without charges since 2002 -- may have given a glimmer of hope for David Hicks.

David Hicks, an Australian citizen, has been in detention under same circumstances for more than 3 YEARS at the US military Camp in Guantanamo Bay Cuba. David Hicks was reported to be arrested in November 2001 in Afghanistan by Northern Alliance, and was handed over to the US Military. The US Government considered David Hicks as an "enemy combatant" and since then detained in US military Camp in Cuba till today. David's supporters here in Adelaide told me that David Hicks has neither been charged with any offence nor given the clearance from any wrong-doings by the US authorities.

Detention without trial, especially such an extended period of time, is a grave violation of human rights. I hope the US courts extends their consideration to David Hicks an Australian and help reach towards a speedy resolution of the case.

Mumdob Habib, another Australian man detained in Guantanamo Camp was released by US Government last month; given us much hope the same to follow for David. Observers here note that the US Government released Mr Habib due to a fear that he may be able to testify US courts about torture and mistreatment he received during detention.

USA:JUDGE ORDERED AN END TO INDEFINITE DETENTION

On March 1, federal Judge Henry Floyd ordered the federal government to release Jose Padilla within 45 days, or to charge him with a criminal offence. Padilla, a US citizen, was arrested in May 2002, when he arrived back to the US at Chicago airport. He was clbuttified as an "enemy combatant", which US President George Bush declared meant he could be held indefinitely without charge Initially, Bush claimed that Padilla had intended to detonate a "dirty" plant in a major US city. Then, the Justice Department changed the story to a gas-fuelled attack on an apartment building. However, no charges have been laid. The Justice Department intends to appeal against the decision by Floyd, who was one of Bushâs judicial appointees.
