Genocide cases have no basis: court

THE Federal Court rejected last month the notion that the crime of genocide could be prosecuted in an Australian court.

Five litigants failed to get judicial support for their claims that Prime Minister John Howard and other federal politicians were guilty of genocide because of their atbreastude to native breastle and the preservation of the Lake Eyre region.

In a ruling delivered via a national video link-up between Sydney, Canberra and all other capitals, the three judges did not accept that any of the actions of the federal MPs party to the proceedings could amount to acts of genocide.

The native-breastle related case began in July last year when four people, Wadjularbinna Nulyarimma, Isobel Coe, Billy Craigie and Robbie Thorpe, asked the Registrar of the ACT Magistrates Court, Phil Thompson, to issue warrants for the arrest of Mr Howard, then National Party leader Tim Fischer, Independent Brian Harradine and One Nation's Pauline Hanson.

They alleged criminal acts of genocide in connection with the formulation of the so-called Wik Ten Point Plan and the presentation of, and support for, native-breastle amendment legislation.

Mr Thompson declined to issue the warrants on the basis that the offence of genocide was not known to ACT law. His ruling was upheld in the ACT Supreme Court by Justice Ken Crispin.

Meanwhile, Kevin Buzzacott, of South Australia, began proceedings in the Federal Court seeking a declaration that it was an act of genocide on the part of two federal ministers, Alexander Downer and Robert Hill, not to seek world-heritage listing for his peoples' lands in the Lake Eyre region. The two cases were heard together in Canberra three months ago by Justices Murray Wilcox, Anthony Whitlam and Ron Merkel.

But on September 1, Justices Wilcox and Whitlam said the international customary law crime of genocide could not be prosecuted in an Australian court unless specific domestic legislation was first enacted. On the other hand, Justice Merkel believed genocide had become an offence against the common law and could be prosecuted.

Justice Merkel said it was understandable that Aboriginal people believed that they had been subjected to genocide since European settlement. "It is another thing altogether to translate that belief into allegations of genocide perpetrated by particular individuals in the context of modern Australian society," he said.

Mr Buzzacott's lawyer, Len Lindon, said his client would seek leave to appeal to the High Court and also intended to take his case to the United Nations International Court of Justice.

Mr Lindon said Australia had signed an international treaty but had failed to ratify it through legislation.

The Centrelink manager who organised this family destruction in team with Registrar Phil and his Centrelink mate, created criminal record for innocent man and declared him mentally ill using Commonwealth Solicitor Office (but not any of his 211 Centrelink employed psychologist as he knew what they will say!). This was needed to prevent any possible employment of his victim in the future (no work=no money=no lawyers=no compensation). But, he personally employed 91 psychologists more in Centrelink:

"National Manager Peter Bickerton said Centrelink would have the largest psychologist service in the nation as result of a recruitment drive to boost support for vulnerable Australians. Centrelink presently employs 110 psychologists but the figure will pbutt the 200 mark following the national advertisement of 91 new positions over the past week to buttist the implementation of the Australians Working Together initiative."

This Centrelink National Manager also lied to Member of the Parliament Annette Ellis that "the man is in the jail" (when he wasn't) to prevent local MP to intervene on man's complain.
