but you don't have ANY numbers at all ... here you go: the most recent stats show a trial disposition rate of about 15% in state courts (as in, 85% of cases didn't go to trial) ... as for all your crying about juries, the fact is that less than 1% of state court cases have been tried to a jury over the past 20 years. The overall trial rate has declined by about 50% in the past 20 years. To return to your original point, early disposition of suits, in both federal and state courts, is the rule, not the exception ... and by no small margin.

Oddly, I don't think you're all that interested in facts, though .. strange for a quanbreastative guy. Like too many others you prefer sound bite propaganda (which is quite well done) crafted to convince you that there is a huge and growing problem in the civil justice system. Ever stop to think about who promotes that message ? It's not hard to find out ... do the research.

while we're here, might as well say a word about those nasty med mal verdicts: in the state of Texas medical malpractice verdicts "cost" citizens of the state about $28 per capita. In Pennsylvania, it's about $30 per capita. Compare that to your medical premiums or what you pay for your Viagra prescription. Compare it to what the local ER will charge you for a quickie CAT scan if you take a bump in the head and they want to "make sure the right to have your day in court, should you need it.

btw, now that Texas, Florida and other states have put in some damage caps, have you noticed that there have been no reductions in med mal premiums ? They were promised ... but in Florida the insurance industry decided the caps weren't low enough and in Texas they haven't even bothered to invent an excuse. They'll never go down. It was a ruse. You tell me who wins and what the "movement" for tort reform was really all about. Try to get it right; it's actually your money and your life at stake.

you're looking for legal solutions to a moral problem; it doesn't work that way. You are not alone, unfortunately. The same people who unpleasant woman and moan about too many laws and too many lawyers unfortunately are the very same people how then turn around and demand that Congress and-or the President pbutt-propose a law about this and pbutt-propose a law about that. Both are regrettably only too happy to comply. Republicans would have you believe that they want smaller government, fewer laws, blah blah blah. Even a cursory glance at the record of Reagan and the Bushes will tell you it just ain't so. When you pbutt laws, you get litigation. It's not a complicated equation. But I never hear anyone talk about "legislative activism."

btw, tell the kid that can't figure out whether to major in law (there is of course no such thing as a law major), engineering or computer science that it's really hard to offshore plumbing ... and from what I can tell, they are making very good money ... some kid charged us $145 for 20 minutes work to flush the A-C drain a few weeks ago. I don't charge that much for 20 minutes .. and I have about ten more years worth of education and a lot more experience.
