We could decide, as we do when resuming private property, to compensate the owner for the removal of his unfettered right to use his own property.

Thus, If the state pays me a fee I will agree not to burn my flag.

As i did not intend to burn my flag, and we have not created new property law (complexity in law increases cost and makes the law less accessible for the battlers) it is a Win Win

Those who want to burn their flags have lost a freedom, so the payment will be quite considerable..

But it is fair to everyone, because the public, if they decide to override personal property rights, will bear the cost as taxpayers.
