Hi folks, I was just reading up on my spouse visa application and came across a thing about the 12 month requirement which has got me worried. i found this :
"The visa applicant and sponsor must have lived together, or not been living apart on a permanent basis, for the 12 months immediately before making the application for the visa unless there are "compelling and compbuttionate circumstances"
as it happens my girlfriend and I have been an item for two years. however we have spent our time together as follows
oct-nov 2003 - Boyfriend girlfriend - both in UK nov 2003 - april 2004 - Me in UK, GF in OZ - Constant contact Apr 04 - aug 04 - Living together in uk Aug 04 - Dec 04 - Me in UK, GF in OZ - Constant contact Jan 05 - present - Living together in Oz

Now , as it is thats 25 months together, approx 15 living together and 10 apart. However as we have not spent the 12 months immediately before making the application together will that hinder our chances or will the time before it make it ok? I'm worried sick about this now. The reason she had to leave the UK in Aug 04 was to be at her grandfathers restbed who she was very close to. We thought it would be best if We just waited until i came over there in Jan 05 and not MAY 05 as we had planned.
Would appreciate some advice on this very much.
