A couple of visa questions Sender: JAJNo it doesn't, however other parts of the legislation insist that in order to be considered as a 'spouse' you need to be living together. If she is in...
Thanks both of you for your replies.
Regarding the RRV how likely is it that DIMIA is going to refuse my family, based on the grounds that they are living in Norway? After all we are still married. The legislation mentioned by George Lombard does not say anything about this.
In the matter of the citizenship issue I agree I am on thin ice. If Norway finds out I have been granted an Australian citizenship, they will ask me to renounce one of them. I will not automatically lose my Norwegian citizenship, but have to choose. The reason for doing this is the same for most other people that obtain citizenship, I do not have to spend two years in Australia every five years. I can choose when I want to return and live in Australia.
So, if the Australian authorities does not inform the Norwegian authorities I will almost certainly be fine. If they find out then one option is to do as Jeremy said and keep my Australian citizenship while my wife keep her Norwegian citizenship. I only have to live in Norway one year before I can apply to get my Norwegian citizenship back.
The only drawback is that my wife will probably not keep her PR. Is it difficult to get her a new visa if I have citizenship?
Best regards Erik
