Hello,

Hi TC There is no discretion whatsoever for a 138 applicant - the person with the skills to pbutt the points test, has to have Vocational English. As I said...

Oh I recognise that Orange has a right to his own point of view - I'm one of those people who believes different points of view make for an interesting forum...

I would like to hear from those of you who have (had) a STNI visa and who have moved to another state for some reason during the first two years.

My husband and I and our two kids aged 1 + 4 are planning to apply for a STNI visa in SA. We would, however, prefer to live in the Albury-Wodonga area (twin cities on the border of NSW and Victoria), which is why we are interested in hearing from those of you having settled in another state, though having signed a declaration that you will live in the Nominating State for at least two years.

Below is what Welsh Tony, whose advice I really appreciate, wrote to me in another thread. Is this how it works?

Thanks in advance,

Regards, Janni

"...The STNI visa is not so restrictive and is a permanent visa - although you will have to sign an undertaking that you will live in the Nominating State for the first 2 years. It is very difficult to restrict Permanent residents of Australia like this. e.g. if after 3 months of living in Adelaide on your STNI permanent visa, there is a chance of a great job in Albury-Wodonga. So you ring up your nominator and advise you would like to go and take up this employment opportunity. South Australia may say, no problem, thanks for letting us know and good luck. they may say you can't do that, Immigration may cancel your visa. You ring Immigration and they may try and bluff you that your visa may be liable for cancellation if you do not live in SA for 2 years. The only way they could possibly cancel your visa if they could prove a false declaration as part of your STNI visa application. They would have to prove that you never intended to stay in South Australia for 2 years, they would also be in danger of restricting basic rights you may have to be able to seek employment for the good of your family anywhere in Australia where you can find it. To the best of my knowledge, nobody has had their 137 visa cancelled for not staying the 2 years in the Nominated State.."
