No instant refusals as a result of recent changes as far as I can see, quite the opposite if anything as in instant points buttessment in stead of having to await for the actual investment to be made.
The situation prior to 01 November was that an buttessment under the points could not be made until the A100K investment had been made and evidenced to DIMIA. This was great for those with occupations later added to MODL who thought that they would have to make the investment to get the required pbutt-mark. As their score had not been officially buttessed, eventhough they had been requested to go for medicals etc, they picked up the extra MODL points and did not need to make the investment. This included applicants who had been requested to make the investment, as long as they had not made the investment, they could advise their case officer that tehy were now on MODL and claim the extra 15 points. Those cases lodged before their occupation went on MODL and were not claiming 5 points for Investment, and had been requested to go for Health and character, would have been officially buttessed for points and could not now claim the 15 points for MODL.
So the change on 01 November was that DIMIA can now award 5 points for applicants claiming that they are willing and able to make the investment, and that 5 points can be awarded before the investment is actually made. So their score buttessment is locked in just the same as for other applicants not claiming 5 points for the investment.
All a bit technical but the only practical change is that, for Independent Skills and SIR applicants who claim the 5 investment points, it shortens the "vulnerable period" between application date and points buttessment date, where changes in legislation-gazettes, can affect your application to disadvantage e.g. your occupation coming off SOL, or advantageously e.g. your occupation being added to MODL.
