I am an American Citizen living in Australia with my fiancee. We are living with her parents, and extremely volatile situation and I simply need to be able to work to be with her. We cannot go to the States as she is banned from entry for another 6 months for overstaying a visa during her last marriage (to an American Citizen as well). We intend to be married as soon as possible, one month at minimum at the moment due to that annoying law. (Marriage licenses in NY State are only *good* for one month, to contrast.) Absurdly enough, if she was *in* the USA now her overstay wouldn't matter. Are they trying to entice me to smuggle her in on a boat or something? (joke)

Ok, so if I can't work I am up the creek. A (nice) official at immigration told me via email the deal, that I will get a bridging visa when I need one*(?), that the no-work provision can be striked off if you prove hardship which is easy to do, and that I will eventually be given a Spouse Visa.

* - This is the $64k question - do I get a bridging visa immediately or do I have to wait for my current visitor's visa to run out, and if I have to wait of my visitor's visa to run out (about 2 1-2 months) can I get the no-work provision striken from my original visa? If the latter is the case and I can't, I am totally up the creek and cannot be with my (soon-to-be) wife.

After much research into this area myself, I would chance the friend...but I would also get an indemnity document in place too(which i hadnt done by the way) and tell them they can...

He also said that if the interviewers believe that our marriage is genuine (and boy is it ever,) they tend to give the Spouse Visas on the spot. What exactly are the chances of such a miracle?

135-140 points is very good, but be sure you are counting things right. You only get to count relationship points if you apply for a 138 or 139 subclbutt visa, which are the Australian...

I would have gotten a fiance visa before I came here but I was not yet divorced from my now former spouse, missed it by about 2 weeks (I am now.) What about if things look bad a quick trip to New Zealand for a fiance visa? I can apply immediately without waiting to be married and thus expect a quicker response. How do you think that would work? Would they give me a temporary visa to enter the country immediately, one that I buttume I can get the no-work provision striken off of?
