I am looking for the following advice on the following and the *-bestway to providepresent my paperworkproof-* before applying andfilling out any forms, or renewing an expired Resident Return Visa, andPartner De Facto visa application. Any advice much appreciated above andbeyond the embbutty responses below.
SCENARIO 1 VISA RENEWAL Is their still a possibility of renewing this migrant visa even at thisstage, as I still have business and financial interest in Australia andwould like to return to live and work.
Further to the above, I have been to and lived in Australia havingstayed their for almost a year on a full five year migrant visa, in thelast five years *(sub clbutt 126, multiple travel, permitted to remain inAustralia indefinitely, not to arrive after April 2005)* but had toreturn to the UK December 2004, due to family commitments and myrelationship with my current Australian female partner. *-I have beenin the UK since; this visa was issued April 2000 and expired in April28th 2005 -* . If you have been living together in a de facto relationship(joint cohabitation in a spouse-like relationship) for a minimum of 12months then you may be eligible. If you have been in a de factorelationship for a minimum of 5 years (or 2 years if you have a childtogether) then you can apply to have the 2 year wait to permanentresidency waived.
The fee for lodging a spouse application at the London office is 585GBP, and the average processing time is 3 - 10 weeks. I've attachedsome information.
CONCLUSION What interests me on the above is the highlighted response, this seemsto suggest that I can now at this stage go for residency on a de factorelationship of 7 years, even though we are not married or engaged justyet, while still living in the UK? What are your thoughts on this and the visa renewal? Obviously if I cango down the route of residency quickly, then the de facto relationshiproute, even in the UK, would seem the best option.
