My uncle Tim would like to migrate to Australia. He is 56 years old and currently receives a medical pension in Holland, because of back pains. His partner Joanna is Australian and Tim wants to become australian through spouse-migration.
Australia and Holland have a medical 'pact' which allowes Dutch people to receive their future Dutch medical pensions in Australia, after they migrate to Ausralia. Tim has recently had a medical examination by the HSA (Health Services Australia, working for DIMIA), after which the HSA asked him for a (new) medical report from a Dutch orthopaedic surgeon.
Question 1: Will DIMIA include his Dutch pension in their buttessment of his migration? In that case, they might be interested if Tims medical condition will stay the same, so that his pension will continue.
Question 2: Tim's medical condition has improved a lot. Will DIMIA refuse Tim's migration because of his backpains, even when he continues to get his Dutch medical pension? In that case, DIMIA might be interested if Tim's backpains are reducing and that he might be able to work in Australia after migration.
