Military Service ought to be a good enough reason to convince DIMA that it is not your fault that you cannot move to Australia very soon, I would have thought.

However, do not delay in dealing with this. Write to the Australian Embbutty nearest to you, explaining the problem. Ask them to put you in touch with whichever section of DIMA you need to discuss the situation with, and to do so urgently.

If you get the impression that DIMA are likely to be difficult, then I would recommend that you contact a solicitor in Melbourne called Tony Kidd. Tony used to work for the Migration Review Tribunal as an in-house solicitor, advising Members of the Tribunal about what they ought to decide in the light of the Law in any given case. That is a migration agent only might be. The MRT deals with appeals concerning RRVs, so Tony's experience is second-to-none in this area of Australian Immigration Law. I have not checked the citizenship provisions, but I am willing to bet that Citizenship by Descent cannot be claimed (and will not be claimable post 2007) if someone is over 18 before their parent even obtains a right to live in Australia at all. I think you will probably find some 'small print' somewhere in the draft legislation which would prevent you from obtaining citizenship unless you first demonstrate that you have fulfilled the residence requirements in the same way as any other mirgating adult.
