Hi there

Spouse Visa, Lodged in the US, part 2
1. Yes, the FBI report is like a criminal history check. You will need to get fingerprints done (we had then done by the federal police in Australia...

I agree with Lili, except that if the Oz Authorities in your country are anything like the staff at the Australian High Commission in London, the only 'help' they are likely to give you is the URL for the DIMA website!

Forget about Citizenship for the moment. You have a far more pressing problem than that, which is how to ensure that you and other members of your family can ensure that all of you will be able to obtain Resident Return visas when the travel-rights provided by your present Visa expire 5 years after the date of its Grant.

There is only ONE sure-fire way for anyone to be 100% confident of being eligible for a 5-year RRV without any restrictions. That way is to spend an aggregate of not less than two years out of your first five post-visa-grant years in Australia. DIMA's atbreastude is that you can work out what the future requirements will be if you study their website and-or consult a Registered Migration Agent carefully enough before deciding whether or not you want to apply for migration, or to apply at the moment. Therefore DIMA considers that responsibility for ensuring that you will be able to comply with the requirements of RRVs etc rests with the applicant and the members of his-her family.

It will NOT be enough if your father is the only member of the family to migrate. If 4 out of 5 migrate, plus you spend every possible moment that you can in Australia during the vacations during your course, then you might be able to argue that you are close to (if not over) having spent the required aggregate of 730 days - 2 years - in Oz. If it is clear that you honestly have tried to reach the two year target, and that only your studies have prevented you from achieving that - and the remainder of your close family are in Australia - it would be difficult for DIMA to say that you cannot demonstrate "close ties" with Australia.

However, the short answer is that your family is likely to have to reconsider your current plans in order to ensure that at least 4 out of 5 of you will be eligible for RRVs without any problems, I suspect.

Good luck with your plans - and with your studies.
