There is no discretion whatsoever for a 138 applicant - the person with the skills to pbutt the points test, has to have Vocational English. As I said before, you may convince a case officer that where ANMC are satisfied that you meet their English Requirements for a successful skills buttessment (minimum of 6.5 in all four categories with minimum band score of 7 in the ACADEMIC version of IELTS) that you would easily meet Vocational English in a GENERAL IELTS test and the case officer would then not ask for an IELTS Test.
No guarantee that they will waive the IELTS but a strong case can be put forward on your behalf - this would not include showing the result that showed you had 4.5 for Reading and Listening as they would have to refuse your application on that basis. Ii is usually the writing that applicants ahve the most difficulty with so I think your wife should be encouraged to re-sit asap (must be at least 3 months between tests). If during the application for a 138, she gets the required minimum of 5 in each of the four categories, then it does not matter if the case officer waives the English requirement or not.
