I want to know what are the chances of getting migrated to australia successfully if someone is deported from USA on non-criminal charges. Actually I am an IT professional with over 9 years of professional exprience, MCSE-MCDBA & Cisco certifications and I have got successfull buttessment from ACS. I got a job offer from a recruitment in USA in 2001. He processed H1B visa for myself and I got the visa stamped in April 2001. But at the beginning of 2001 there was a big slump in USA economy and for that reason many companies layed off thousands of employees and freezed new hiring plans. My employer-recruiter was supposed to invite me to come to USA as soon as visa was stamped and then find a job for me. Based on this understanding I resigned from my current job in my native country as soon as I got the visa. But when I approached my recruiter in USA, he asked me not to come to USA and wait till the job market betters. I waited for 4-5 months and still did not get positive response from the recruiter. So I decided to go to USA as I had the visa stamped. I landed in USA on 26th Aug, 2001. Then the tragedy of 9-11 happened just few days after I landed in USA. The whole situation in USA changed drastically. Now to cut the long story short, I was held by INS because of my H1b visa went out of status as I was not working for the sponsor. They put a case on me and deported me out of USA. I was really scared about the political situation then and out of fear that If I decided to contest with INS, I may be detained for long time bcoz of the sitation after 9-11. I was not deported because of any criminal offense ( I have documentary evidence from INS proving this claim), but only because my visa had expired and I was supposed to leave the USA within 10 business days after the expiry, which I did not obey. Please tell me what impact this story can have on my Australian immigration policy? I am already done with ACS and now want to proceed with DIMIA application? Is there any connection between DIMIA & INS? Do DIMIA & INS consult and share information with each other automatically even if it is not disclosed?
