Thanks Anne. We had applied for 138 and my brother was our sponsor. He's my full natural brother, but had been adopted as a baby. DIMIA would not recognise him as my legal brother and, therefore, our sponsor so they refused us after 14 months of waiting. What a nightmare. We are appealing, but not very hopeful. Anyway, just as we had sent off our side of appeal to my brother (he had to be the one to do the appeal), electricians were added to MODL so we now had the 15 points for the 136 that we were short of before (my hubby is an ancient 43!!) We didn't use an agent as we thought our app was straightforward, although to be quite honest, I don't even think an agent would have spotted this coming. I couldn't believe it when Superam76 was refused for the exact same reason. Just red tape - both skills very much needed (electrician and bricklayer) and, certainly in our case as we had gone that far, healthy meds, bond lodged, etc. Don't get me started! Am hoping to God this time that we might go straight to Visa grant as we all did fresh meds and got new pcc's and I sent them off once I get the file number. Hopefully, once we get a CO allocated, it should all be pretty quick after that. Wishful thinking! Maybe we'll get a sympathetic CO? Feel we were quite badly treated last time, as our case was obviously not read properly until it was time to grant visa - such an awful waste of time. It was obvious from the start about my brother being adopted, so they should really have refused us at least once a CO had first buttessed our case. Or......might get same CO???!!!
