2 &3 - no problem nominating a 40 point occupation and claiming work experience in a 50 point occupation as long as:
a) you have a qualfication that will be recognised to be the equivalent of an Australian Diploma (presumably you do not have a degree equivalent qualification).
b) You can show additional work experience-career path in the 50 point occupation that effectively "tops up" your skill level from the diploma to the required degree level of the 50 point occupation - e.g. you have a HNC in accounting and you then have 2 years experience as a Personnel buttistant and then 2 years as a Personnel Officer. You need to evidence to DIMIA that you have 2 years in the last 3 years in the send 50 point occupation, as it is a degree skill level and you only have a diploma, you can claim that the last 2 years was send, not just from the duties of the position, but that you are send in that you have a diploma plus 2 years of experience as a Personnel buttistant, before you undertook the position of Personnel Officer. So you will be arguing that your Diploma plus 2 years as a PErsonnel buttistant is equivalent training to a degree, which is a strong argument. So it is not buttimple as some make out that you nominate one occupation and have experience in another.

4 For 5 spouse points You need - 2 years of send experience in last 3 years, be under 45 when application is made, have successful Skills buttessment in your nominated occupation and have Vocational English.
