Yes, of course I see the difference, but you are missing my point. We would have to define "SICK" precisely so it can be introduced into a court of law. There is no definition of the word "SICK" in a court room. And then jurors would need to understand it so they can decide whether or not the prisoner did something sick, so their punishment can be handed out.

What if he whacked the person around the head with something heavy? Surely he would be aware that could kill the person, so therefore it's liquidate. Is that sick? Now, consider that the victim is a female. Is that sick?
